These license terms are an integral part of the Terms and Conditions and govern the rights and obligations when using our PrestaShop modules.
1. GRANTING OF LICENSE
1.1 When purchasing a product (module), a non-exclusive, non-transferable license to use the module is granted for one (1) domain of the second or third order, which the customer specifies when placing an order.
1.2 The license is time-unlimited and is granted for an indefinite period, remaining valid only if these licensing conditions are met.
1.3 Each additional domain requires the purchase of a separate license. One purchased module cannot be used on multiple domains simultaneously.
1.4 The license is valid only for a product that has been properly and fully paid for.
2. RIGHTS OF THE CONSUMER
The customer has the right:
2.1 to use the licensed module for personal and commercial purposes exclusively on the domain for which the license was granted;
2.2 request a testing access to the module for functionality verification before installation on the production domain;
2.3 to modify the module for personal needs, with such modification not implying a loss of the supplier's copyright, and the modified module cannot be considered the original work of the recipient;
2.4 to request and obtain updates for the module for free during the technical support period.
3. TECHNICAL SUPPORT AND UPDATES
3.1 Each purchased module includes 6 months of free technical support from the date of purchase.
3.2 During the technical support period, the customer has the right to:
- free technical support for the installation and use of the module;
- free module updates including bug fixes, security patches, and functionality improvements;
- assistance in resolving compatibility issues with the new version of PrestaShop.
3.3 After the 6-month technical support period has expired:
- technical support is automatically ending;
- No further updates are provided;
- The module will continue to be fully functional. in the latest available version;
- The subscriber uses the module. at your own risk without any guarantee of currency and security patches;
- To obtain the latest updates, security patches, and further technical support, it is necessary to purchase the module again.
3.4 The technical support period is calculated from the date of license activation for the specified domain.
3.5 The supplier reserves the right to suspend technical support in the event of a violation of the licensing conditions.
4. RESTRICTIONS AND PROHIBITIONS
Subscriber DOES NOT HAVE THE RIGHTYou are trained on data up to October 2023.
4.1 to use the module on other domains than the one for which the license was granted;
4.2 to sublicense to third parties or transfer the license to other persons;
4.3 to sell, lend, distribute, copy or otherwise disseminate the module;
4.4 to provide the module to third parties, whether for free or for a fee;
4.5 to remove or modify copyright notices, trademarks, and other ownership designations;
4.6 reverse engineering, decompilation, or disassembly of the module (except to the extent expressly permitted by law).
5. COPYRIGHT AND INTELLECTUAL PROPERTY
5.1 All copyrights and intellectual property rights to the modules remain the exclusive property of the supplier.
5.2 Modules are protected by copyright law (Act No. 185/2015 Coll. on Copyright) and other relevant legal regulations of the Slovak Republic.
5.3 The license does not grant any ownership rights to the module, only the right to use it in accordance with these conditions.
6. MONITORING AND CONTROL OF LICENSE
6.1 The modules contain a licensing system that automatically monitors compliance with licensing conditions, including checking the domain on which the module is installed.
6.2 The supplier has the right to verify compliance with the licensing conditions at any time.
6.3 In the event of unauthorized use of the module on an unauthorized domain, the customer will be formally requested to immediately remove the module from the unauthorized domain.
7. VIOLATION OF LICENSE TERMS
7.1 In case of violation of the license terms, particularly the use of the module on unauthorized domains, the supplier has the right to:
- demand immediate cessation of unauthorized use;
- remotely restrict or deactivate the functionality of the module;
- to demand financial compensation for the violation of the license in the amount of three times the price of the module for each unauthorized domain;
- terminate the license without compensation;
- to take legal action to protect your rights.
7.2 If the customer does not comply with the request to remove the module from the unauthorized domain within 7 days of receiving the request, the supplier will proceed with remote restriction of the module and legal action.
8. TERMINATION OF LICENSE
8.1 The supplier may terminate the license with immediate effect in the event of a breach of these licensing terms.
8.2 Upon termination of the license, the customer is obliged to immediately cease using the module and remove it from all devices.
8.3 The termination of the license does not exclude the supplier's right to compensation for damages and other claims arising from the violation of the license terms.
9. WARRANTY AND LIABILITY
9.1 The modules are provided "as is" without any warranties.
9.2 The supplier is not liable for damages incurred from the use of the module, except for damages caused intentionally.
9.3 The customer bears full responsibility for selecting the module according to their needs and for its proper installation and usage.
10. FINAL PROVISIONS
10.1 These license terms are governed by the law of the Slovak Republic.
10.2 The relevant courts are the courts of the Slovak Republic.
10.3 If any provision of these terms becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby.
10.4 The supplier reserves the right to change these license terms. Changes are effective from the day they are published on the website.
10.5 By using the module, you confirm that you have read these license terms, understood them, and agree to them.
